Privacy Policy

ASUKA Tourism Interpreter & Guide Association. (the “Association”) understands the importance of protecting the User’s personal information and will observe the Act on the Protection of Personal Information (the “Act”) and endeavor to handle and protect personal information in an appropriate manner in accordance with this Privacy Policy (the “Privacy Policy”). Unless otherwise expressly defined herein, the definition of terms herein shall be subject to the definition in the terms of use of the Service (the “Terms of Use”).

1. DEFINITION

In the Privacy Policy, personal information shall mean “personal information” defined in paragraph 1 of Article 2 of the Act, i.e. the information regarding a living individual which can identify a specific individual by name, date of birth or other description contained in such information (including information which may be easily referred to other information and will thereby enable identification of a specific individual).

1. PURPOSE OF USE

The Association shall use customers’ personal information for the following purposes:

(1)   Provision of the Service.

(2)   Notifications and responses to customer inquiries, with respect to the Service.

(3)   Announcement regarding the Association’s products or services, etc.

(4)   Dealing with breach of the Association’s terms of use, policy, etc. (the “Terms”), with respect to the Service.

(5)   Notifications of amendment to the Terms of Use.

(6)   Improvement of the Association’s service and development of new service, etc.

(7)   Creation of statistics data which is processed so that no particular individuals shall be identified,

    in connection with the Association’s service.

(8)   Provision to a third party under the Privacy Policy; or

(9)   other purposes related to the above purposes.

1. CHANGE OF PURPOSE OF USE

The Association may change the purpose of use of personal information to the extent that the purpose of use after the change is reasonably deemed duly related to the original purpose of use.  When the purpose of use has been changed, the Association shall notify the customer of, or publicly announce the purpose of use after the change.

1. RESTRICTION ON USE

The Association shall not use personal information, without the consent of the relevant customers, beyond the scope necessary for the achievement of the purpose of use, unless permitted by the Act or other laws or regulations; provided, however, that this provision shall not apply if:

(1)   the use of personal information is based on laws and regulations.

(2)   the use of personal information is necessary for the protection of the life, body or property of an individual and it is difficult to obtain the consent of the relevant customers.

(3)   the use of personal information is especially necessary for improving public health or promoting the sound growth of children and it is difficult to obtain the consent of the relevant customers; or

(4)  the use of personal information is necessary for cooperating with a national government, a local government, or a person or entity entrusted thereby in executing the affairs prescribed by laws and regulations and acquisition of the consent of the relevant customers may impede the execution of the affairs concerned.

1. PROPER ACQUISITION

The Association shall acquire personal information by a proper means and shall not acquire it by a deception or other wrongful means.

1. SECURITY CONTROL

The Association shall sufficiently and appropriately supervise the Association’s members to ensure the security control of personal information against the risk of loss, destruction, alteration or leakage.  When the Association entrusts a third party with the handling of personal information in whole or in part, the Association shall sufficiently and appropriately supervise the third party to ensure the security control of personal information.

1. PROVISION TO A THIRD PARTY

7.1 The Association will disclose and provide the Traveler’s personal information below held by the Association to the Guide with whom the Traveler executes the Tour Agreement.

7.2 Except for the preceding paragraph, the Association shall not provide personal information to a third party without the prior consent of the relevant customers, unless the disclosure is permitted by the Act or other laws or regulations; provided, however, that the following cases shall not be regarded as the provision to a third party:

(1)   Cases where the Association entrusts a third party with the handling of personal information within the scope necessary for the achievement of the purpose of use.

(2)   Cases where personal information is provided as a result of the succession of business in a merger or otherwise or

(3)   Cases where personal information is used jointly with others in accordance with the provisions of the Act.

1. DISCLOSURE

In cases where the Association is requested by a customer to disclose the personal information under the Act, the Association shall, after confirming that the request is made by the principal, disclose the personal information to the customer without delay, provided, however, that this provision shall not apply to cases where the Association is not obliged to disclose such personal information under the Act or other laws or regulations. 

1. CORRECTION, ETC.

In cases where the Association is requested by a customer to correct, add or delete the personal information under the Act on the ground that such personal information is contrary to the fact, the Association shall, after confirming that the request is made by the principal, make a necessary investigation without delay within the scope necessary for the achievement of the purpose of use, and on the basis of the result, correct, add or delete the personal information and notify the customer to that effect, provided, however, that this provision shall not apply to cases in which the Association is not obliged to make such correction, addition or deletion under the Act or other laws or regulations.

1. DISCONTINUANCE OF THE USE, ETC.

In cases where the Association is requested by a customer to discontinue using or to erase the personal information under the Act on the ground that such personal information is being handled beyond the purpose of use publicly announced in advance or has been acquired by a deception or other wrongful means and where it is found that the request has a reason, the Association shall, after confirming that the request is made by the principal, discontinue the use of or erase the personal information without delay and shall notify the customer to that effect; provided, however, that this provision shall not apply to cases in which the Association is not obliged to make such discontinuance or erasure under the Act or other laws or regulations.

1. USE OF COOKIES AND OTHER TECHNOLOGIES

Cookies or similar technologies may be used in the Association’s service.  Such technologies help the Association to recognize the status of use of the Association’s service, etc. and contribute improvement of the service.  When a user intends to disable cookies, the user may disable cookies by changing the web browser’s settings.  Please note that when cookies are disabled, a part of the service may be unavailable.

1. CONTINUOUS IMPROVEMENT

The Association shall endeavor to review timely the status of the operation regarding handling of personal information and to improve such operation continuously.  The Association may amend this Privacy Policy as necessary.

 飛鳥観光通訳ガイド協会（以下「協会」）は利用者の個人情報の重要性を理解し、個人情報保護に関する法律（以下「法律」）を遵守し、本プライバシーポリシー（以下「プライバシーポリシー」）に従い適切な方法において個人情報を取扱い保護する努力を行う。本契約に別途明確に定義されない限り、本規約における用語の定義はサービス利用規約（以下「利用規約」）において定義される。

１．定義

本プライバシーポリシーにおいて個人情報は法律の第2条第１項において定義される「個人情報」を意味する。すなわち、その情報に含まれる氏名、生年月日、その他記載事項により特定される生存している個人についての情報を意味する。（他の情報と容易に照合することができ、それにより特定の個人を識別することができるものを含む。）

２．使用目的

協会は顧客の個人情報を次の目的のために使用する。

（１）  サービスの提供。

（２）  サービスに関する通知およびの顧客の質問への返答。

（３）  協会の製品およびサービスに関する告知。

（４）  サービスに関する協会の利用規約、方針等（以下「規約」）に対して違反があった場合の処置。

（５）  利用規約修正の通知

（６）  協会のサービス改善や新サービスの開発など。

（７）  協会のサービスに関連した、個人の特定がなされないような統計データの作成。

（８）  プライバシーポリシーのもとでの第三者への提供、もしくは上述の目的に関連する他の目的。

３．使用目的の変更

協会は変更後の使用目的が本来の目的に正しく関連していると合理的に認められる限りにおいて、個人情報の使用目的を変更することができる。使用目的が変更された場合は、協会は顧客に対して通知する、もしくは公に変更後の使用目的を告知するものとする。

４．使用制限

協会は当法律や他の法律および規制によって許諾されることなしに、関係顧客の同意を得ずに使用目的の達成のために必要の範囲を超えて個人情報を使用してはならない。しかしながら、次の内容に該当する場合は適用除外とする。

（１）  個人情報の使用が法律や規制に基づいている場合。

（２）  個人情報の使用が個人の生命、身体、資産の保護に必要であり、かつ関係顧客の同意を得ることが難しい場合。

（３）  個人情報の使用が公衆衛生の改善や子供の健やかな成長を促進するために必要であり、かつ関係顧客の同意を得ることが難しい場合。

（４）  個人情報の使用がその任務の遂行を法律や規制によって委ねられた国、地方政府もしくは個人および団体などの協力上必要な場合、もしくは関係顧客の同意を得ることが任務の遂行の妨げになる場合。

５．　適切な取得

協会は適切な方法によって個人情報を取得するものとし、詐欺や不当な手口でこれを取得するものではない。

６．　セキュリティコントロール

協会は協会員に対し、個人情報の紛失、破壊、改変、漏えいのリスクに対してセキュリティコントロールを確保するため十分で適切な指導をするものとする。協会が第三者に個人情報の取り扱いを委託する場合は、個人情報のセキュリティコントロールを確保するためその第三者に対して十分で適切な指導をするものとする。

７．　第三者への提供

7.1　協会はその旅行者がツアー契約を結んだガイドに対し協会が保持する旅行者の下記個人情報を開示する。

・氏名

協会はそのガイドがツアーサービス契約を結んだ旅行者に対し、協会が保持するガイドの下記個人情報を開示する。

・氏名

・電話番号

・メールアドレス

7.2  前項を別にすれば、情報の開示が法律で許されない限り、協会は関係顧客からの事前承諾なしに第三者に対し個人情報の提供は行わないものとする。ただし、次の場合は第三者への提供とはみなされないものとする。

(1)　協会が利用目的の達成の範囲内で第三者に個人情報の取り扱いを委託する場合。

(2)　合併その他、事業の継承により個人情報が提供される場合。

(3)　法律の規定に従って個人情報が他者と共同で使用される場合。

８．　開示

協会が法律のもとで個人情報を開示するように顧客から求められた場合、協会はその要求が原則に則ったものであるか確認したうえで、速やかにその個人情報を顧客に開示するものとする。しかしながら、法律や規制のもとで、そのような個人情報の開示が当協会の義務には当たらない場合、この条項は適用されないものとする。

９．　訂正

もし協会が顧客からその個人情報が事実に反するという理由で、法律に基づいてその訂正、加筆、削除を求められた場合、協会はその要求が原則に則ったものであることを確認したうえで、利用目的の達成に必要な範囲内で速やかに必要な調査を行いその結果に従って、その個人情報の訂正、加筆、削除を行い、顧客にその旨を通知するものとする。しかしながら、法律やその他の規制のもとで、そのような訂正、加筆、修正を当社が行う義務がない場合はこの条項は適用されないものとする。

１０．利用の停止など

もし協会が顧客からその個人情報が事前に公に発表された利用目的の範囲を超えて使用されている、もしくはその個人情報が詐欺や不当な手口で取得されたという理由で法律に基づいてその個人情報の利用の停止や削除を求められ、その要求が理解できるものである場合、協会はその要求が原則に則ったものであることを確認したうえで、速やかにその個人情報の利用の停止もしくは削除を行い、顧客にその旨を通知するものとする。しかしながら、法律やその他の規制のもとで、そのような利用停止や削除を当社が行う義務がない場合はこの条項は適用されないものとする。

１１．COOKIESなどその他技術の使用

協会のサービスにはCookiesや類似の技術が用いられている。そのような技術により協会は当サービスの利用状況を知ることができる。もしcookiesが機能しないようにしたい場合は、利用者はウェブブラウザのセッティングを変更することによってcookiesが機能しないようにできる。Cookiesが機能しなくなると当サービスの一部が利用できなくなりますのでご注意ください。

１４．　継続的な改善

協会は個人情報の取り扱い状況について日々見直しを行い、取扱いの改善に努めるものとする。協会は必要に応じて当プライバシーポリシーを修正することができる。
